These Terms and Conditions set out the basis on which Rubbish Removal Ealing provides rubbish removal, waste collection and related clearance services to residential and commercial customers. By booking a service, accepting a quotation or allowing our operatives to begin work, you confirm that you have read, understood and agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business or organisation booking waste removal or related services with Rubbish Removal Ealing.

Services means any rubbish removal, waste collection, loading, carrying, sorting, transportation, disposal, recycling, clearance, or related services provided by Rubbish Removal Ealing.

Waste means any rubbish, junk, household waste, garden waste, commercial waste or other materials presented to us for collection and removal, excluding any prohibited or hazardous items as defined in these Terms and by applicable law.

Agreement means the contract between the Customer and Rubbish Removal Ealing incorporating these Terms and Conditions, any quotation and any written confirmation of booking.

2. Scope of Services

Rubbish Removal Ealing provides on-demand and scheduled rubbish removal and waste collection services, including but not limited to household clearances, garden waste removal, commercial rubbish collection, bulky item removal, and general waste collection within our service area.

The exact scope of the Services for each job will be as agreed in the quotation or booking confirmation. We reserve the right to adjust the scope and pricing if, upon arrival, the volume, type or location of waste differs from the information supplied at the time of booking.

We do not provide structural building work, plumbing, electrical work, cleaning services or any services other than waste removal and related activities unless expressly agreed in writing.

3. Booking Process

Bookings can be made by telephone, email or other communication methods made available by Rubbish Removal Ealing from time to time. The Customer must provide accurate and complete information, including the address of the collection, contact details, access information, type and estimated volume of waste, and any relevant site conditions.

Any quotation provided is based on the information supplied by the Customer. Quotations are not binding until confirmed in writing or verbally at the time of booking and are subject to revision if circumstances change or if the information originally provided was inaccurate or incomplete.

Your booking is accepted and an Agreement is formed when we confirm the booking and provide a scheduled date and time window for the collection. We will use reasonable efforts to attend during the agreed time window but this is an estimate only and not a guarantee.

4. Access and Customer Responsibilities

The Customer is responsible for ensuring that our operatives have safe, reasonable and timely access to the premises and to the waste that is to be removed. This includes providing any necessary entry codes, instructions for parking, and permission to access shared or common areas where relevant.

The Customer must ensure that the waste is presented in a way that is reasonably accessible, not obstructed by other items, and safe for manual handling. The Customer must inform us in advance of any relevant site conditions, such as restricted access, stairs, long carrying distances, lack of parking, or other factors that may affect the time or difficulty of the job.

If our operatives are unable to gain access to the premises or the waste due to circumstances beyond our control, including the Customer not being present where required, we may charge a missed collection fee or a call-out fee to cover our costs.

5. Waste Types and Prohibited Items

Rubbish Removal Ealing collects general household, garden and commercial waste, subject to compliance with applicable waste regulations and our policies. We reserve the right to refuse collection of any waste that we reasonably believe to be hazardous, illegal, excessively heavy, unsafe to handle, or otherwise outside the scope of the quotation and our standard services.

Without limitation, we generally do not collect the following materials unless expressly agreed in writing and in compliance with all legal requirements: asbestos, clinical and medical waste, chemicals, solvents, oils, paints, pressurised containers, gas bottles, explosives, radioactive materials, certain electrical items requiring specialist disposal, or any other waste classified as hazardous or requiring special handling or permits.

The Customer is responsible for declaring any hazardous or special waste in advance. If such waste is discovered on site that has not been declared, we may refuse to remove it and may still charge for our attendance and any work undertaken. If we inadvertently collect prohibited wastes due to the Customer’s failure to disclose, the Customer will be liable for any additional disposal costs, regulatory penalties, or damages incurred as a result.

6. Pricing and Quotations

Prices for our waste collection services are typically based on factors such as estimated volume or weight of waste, type of materials, labour time, difficulty of access, and disposal and recycling costs. We will provide an estimated price or a price range at the time of booking based on the information provided.

On arrival, our operatives will assess the waste and confirm or revise the price before starting work. If the Customer does not agree to any revised price, no work will be carried out and we may charge a call-out fee to cover our costs.

All prices are quoted in pounds sterling and, unless stated otherwise, are inclusive of standard waste transfer and disposal costs and any applicable taxes. Additional charges may apply where there is excessive loading time, difficult access, long carry distances, or items requiring special disposal.

7. Payment Terms

Unless otherwise agreed in writing, payment is due in full on completion of the collection service. We may accept payment by cash, credit or debit card, bank transfer or other methods as specified by us from time to time.

For business customers or larger projects, alternative payment terms may be agreed, including deposits or payment on invoice. Where invoices are issued, they are payable within the period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date.

We reserve the right to charge interest on overdue sums at the statutory rate and to recover any reasonable costs of debt collection, including legal fees, from the Customer. Legal title to all collected waste transfers to us only once payment has been received in full, subject always to compliance with waste regulations.

8. Cancellations and Amendments

The Customer may cancel or amend a booking by giving us as much notice as reasonably possible. Cancellations or changes must be communicated by telephone or by another method we accept for this purpose.

We may, at our discretion, charge a cancellation fee if a booking is cancelled or materially changed with less than 24 hours notice before the scheduled collection time, to cover our administrative and scheduling costs. If our operatives have already been despatched or have arrived at the premises, we may charge a call-out fee or a proportion of the quoted price.

We reserve the right to cancel or reschedule a booking at any time due to circumstances outside our reasonable control, including but not limited to adverse weather, traffic disruption, vehicle breakdowns, staff illness or safety concerns. In such cases, we will use reasonable efforts to notify the Customer and arrange an alternative time.

9. Performance of the Services

Our operatives will perform the Services with reasonable care and skill, taking into account health and safety requirements and the conditions on site. We will make reasonable efforts to collect all agreed waste, tidy the collection area, and minimise disruption.

We are not obligated to remove items that were not included in the original quotation where doing so would be unsafe, unlawful or unreasonable. We also reserve the right to leave behind any items that cannot be safely removed due to structural constraints, infestation, contamination or other hazards.

Any times or dates given for the performance of the Services are estimates only. While we will make reasonable efforts to meet agreed time windows, we will not be liable for any loss or inconvenience arising from early or late arrival, provided we perform the Services within a reasonable time.

10. Liability and Limitations

Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.

Subject to the foregoing, our total liability to the Customer arising out of or in connection with the provision of the Services, whether in contract, tort or otherwise, shall be limited to the total price paid or payable for the specific job giving rise to the claim.

We will not be liable for any indirect or consequential losses, including loss of profit, business interruption, loss of data, or loss of enjoyment. We will not be liable for any pre-existing damage to property, fixtures or fittings, or for damage arising from defects, weaknesses or instability in the premises or items being removed.

The Customer must notify us in writing of any claim for damage or loss as soon as reasonably practicable and, in any event, within 7 days of the completion of the Services. We may require evidence, photographs, access to inspect, and a reasonable opportunity to remedy any damage where appropriate.

11. Customer Indemnity

The Customer agrees to indemnify and hold harmless Rubbish Removal Ealing, its employees and agents from and against any claims, losses, damages, costs or expenses arising from:

a. The Customer’s failure to disclose hazardous or prohibited waste.

b. The Customer’s breach of these Terms and Conditions.

c. Any false or misleading information supplied by the Customer about the waste or premises.

d. Any third-party claims arising from the Customer’s instructions or from waste that did not lawfully belong to the Customer.

12. Compliance with Waste Regulations

Rubbish Removal Ealing operates in accordance with applicable UK waste management legislation and duty of care requirements. We will transport and dispose of collected waste only at authorised facilities and will use reasonable efforts to maximise reuse and recycling where practicable.

Where required by law, we will issue appropriate documentation such as waste transfer notes. The Customer must provide any information reasonably required for regulatory compliance, including accurate descriptions of waste and confirmation of its origin.

The Customer acknowledges that we may be required to share certain information with regulators and authorised bodies in order to comply with legal obligations relating to waste handling, environmental protection and public safety.

13. Data Protection and Privacy

We will collect and process personal data provided by the Customer in connection with bookings and the performance of the Services. This may include names, contact details, addresses, payment information and job details.

We will use such data only for legitimate business purposes, including managing bookings, performing the Services, processing payments, handling queries and complying with legal obligations. We will take reasonable steps to keep personal data secure and will not sell or share it with unrelated third parties except where necessary for the performance of the Services, for payment processing, for debt recovery, or where required by law.

14. Complaints

If the Customer is dissatisfied with any aspect of the Services, they should contact us as soon as possible so that we have an opportunity to address the issue. We will investigate complaints promptly and, where appropriate, may offer to rectify problems, provide an explanation, or agree a fair resolution.

Raising a complaint does not entitle the Customer to withhold payment for Services that have been properly provided, save where we expressly agree otherwise.

15. Variations to these Terms

We reserve the right to update or amend these Terms and Conditions from time to time to reflect changes in our services, business practices or legal requirements. The version of the Terms and Conditions that applies to a particular booking will be the version in force at the time the booking is confirmed.

Any variation to these Terms and Conditions requested by the Customer is only valid if agreed in writing by an authorised representative of Rubbish Removal Ealing.

16. Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall, to the extent required, be deemed not to form part of the Agreement, and the remaining provisions shall continue in full force and effect.

17. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services, whether in contract, tort or otherwise.

18. Entire Agreement

These Terms and Conditions, together with any quotation and booking confirmation, constitute the entire agreement between the Customer and Rubbish Removal Ealing in relation to the provision of the Services and supersede any prior statements, negotiations or representations, whether oral or written.

By booking or using our rubbish removal and waste collection services, the Customer confirms acceptance of these Terms and Conditions in full.
